Vestly is provided by Vision Publishing LLC, 2105 Vista Oeste NW Suite E #3990, Albuquerque, NM 87120, USA.
2. Acceptance
By downloading, accessing, or using Vestly, you agree to these Terms of Use and our Privacy Policy.
3. License
Subject to your compliance with these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Vestly for personal, non-commercial purposes on Apple or Android devices you own or control.
4. App Store and Google Play Terms
Vestly is distributed through Apple. If any provision of these terms conflicts with mandatory obligations imposed by Apple for iOS apps, Apple’s terms will prevail to the extent of the conflict.
On Android, Vestly is distributed through Google Play. If any provision of these terms conflicts with mandatory obligations imposed by Google for apps distributed on Google Play, the Google Play terms will prevail to the extent of the conflict.
5. Eligibility and User Responsibilities
- You must use the app lawfully and only with images and clothing you have the right to use.
- You must not upload unlawful, abusive, non-consensual, misleading, or counterfeit content.
- You must not use the app to impersonate someone else or create harmful or defamatory content.
6. AI-Generated Content
Vestly uses AI-assisted processing to analyze clothing and generate try-on images. Results are synthetic, may contain inaccuracies, and are provided solely for styling, preview, and visualization purposes.
7. Subscriptions
Some Vestly features require a paid subscription or introductory offer purchased through Apple in-app purchases or, on Android, through Google Play. The plan length, price, and details of any trial period are shown in the app at the time of purchase.
- Payment is charged to your Apple ID after you confirm your purchase.
- On Android, payment is charged to the payment method on your Google Play account after you confirm your purchase.
- App Store subscriptions renew automatically unless you cancel at least 24 hours before the current period ends.
- Your Apple account may be charged for renewal within 24 hours before the current period ends.
- On Google Play, your subscription renews automatically at each renewal date unless you cancel before then; cancellation takes effect at the end of the current period.
- You can manage or cancel your subscription in your Apple account settings at Apple Subscriptions.
- On Android, you can manage or cancel your subscription in the Play Store (Payments and subscriptions, then Subscriptions) or at Google Play Subscriptions.
- Deleting the app or your data doesn’t cancel an active Apple or Google Play subscription.
8. Restore Purchases
If you’ve already paid for access, you can use the in-app restore option to reload your entitlements on the same Apple account or, on Android, the same Google account.
9. Account and Data Deletion
Vestly includes an in-app process to delete data linked to your account. This process is intended to remove local data and request server-side deletion for the relevant app identifier, but it does not replace canceling your subscription through Apple or Google Play. You can also request this deletion by email, without the app: see the page Help.
10. Intellectual Property
Vestly, its software, branding, and website content belong to Vision Publishing LLC or its licensors. You retain the rights you already hold to the content you submit, but you grant us the limited rights needed to operate the app and provide the requested result.
11. Availability and Changes
We may change, suspend, or discontinue any part or all of Vestly at any time, including features, pricing displays, or the infrastructure used for AI processing.
12. Disclaimer of Warranties
Vestly is provided “as is” and “as available,” to the extent permitted by law. We don’t guarantee uninterrupted availability, freedom from errors, or a perfect match between generated images and the actual fit, texture, drape, or color of clothing.
13. Limitation of Liability
To the extent permitted by law, Vision Publishing LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of Vestly.
14. Termination
We may suspend or terminate access if you violate these terms, misuse the service, or use the app in a way that creates legal or operational risk.
15. Governing Law
These terms are governed by the laws of the State of New Mexico, USA, without regard to conflict-of-law rules, unless mandatory consumer protection laws require otherwise.
